For those of you buying a new home from a builder there is a clause I want to bring to your attention. This clause states that if some third party (bricklayer, drywaller, painter etc) files a lien against the property you are buying before closing you agree to accept the builder's promise to get rid of the lien. This may be ok in some circumstances, but what if your lender (bank, etc) decides not to accept the builder's promise. You are stuck potentially not closing, losing your deposit and getting sued. I suggest that you have your lawyer change this clause so you are protected. |
